Acceptable Use Policy

    

ShastaNet is a community owned corporation organized under Federal Tax Code provision 501(C)3. The mission of ShastaNet is to provide low cost/no cost telecommunications to the residents of Shasta County. In order to accomplish this mission, ShastaNet Shasta County will ensure residents free and widely available access to public and private information services via electronic connection.

All ShastaNet information providers assume responsibility for providing reasonable publicity for the ShastaNet Acceptable Use Policy at their sites and for communicating this policy to an appropriate administrative authority at all sites connected to theirs via connections that are not supported by ShastaNet. Ultimate responsibility for traffic that does or does not conform to this policy is with the individual end-user who originates the traffic.

It is the policy of ShastaNet to provide access to the broadest possible number of organizations connected to the Internet. This is accomplished through connectivity to one or more national backbone networks. Any traffic that exits ShastaNet to the numerous other networks to which ShastaNet is connected must conform to the acceptable use policies governing those networks.

All traffic originating at a ShastaNet site, or connected via a ShastaNet site, including state networks and other connections, shall be for purposes of, or in support of:
  • research
  • education
  • state, local, or national governmental affairs
  • economical development
  • public health
  • public service

It is not acceptable to use ShastaNet for any purpose which violates US or state laws.

It is not acceptable to use ShastaNet to interfere with or disrupt network users, services or equipment. Such interference or disruption includes, but is not limited to:

  • distribution of unsolicited advertising
  • propagation of computer worms or viruses
  • using the network to make unauthorized entry to other computational, information, or communications devices or resources.

The Board of Directors of ShastaNet, or their designee, will review alleged violations of the ShastaNet Acceptable Use Policy on a case-by-case basis. Clear violations of the policy which are not promptly remedied by the relevant person may result in disciplinary action by ShastaNet up to and including expulsion by the person or organization from ShastaNet, termination of ShastaNet services, and forfeiture of any membership dues or fees paid to date.

ShastaNet reserves the right to suspend or revoke user privileges at any time for conduct that does not (comply with/adhere to) these standards and those of the ShastaNet community. The Board of Directors of the ShastaNet will be the sole arbiter.

ShastaNet reserves the right to modify this policy at any time. Notification of all such modifications will be posted on the network 30 days prior to their effective date. Questions related to the ShastaNet Acceptable Use Policy should be e-mailed to the Board of Directors herein listed.

ShastaNet Acceptable Use Policy Agreement

In exchange for the use of ShastaNet, I understand and agree to the following:

1. The use of ShastaNet is a privilege. The responsibilities that come with this privilege are to be civil, courteous, polite and lawful. I shall abide by all applicable federal, state or local law pertaining to such areas as libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement.

The information available on ShastaNet includes intellectual property that is protected under copyright, trademark and Intellectual Property Laws of the United States and/or other countries. I understand that such Intellectual Property Laws generally prohibit the unauthorized reproduction, distribution or exhibition of all text, photographic and graphic images (including electronic images), sound samplings, and other protected materials. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties.

I understand that ShastaNet subscribes to the principles stated in the first Amendment of the Constitution of the United States. The network may provide information and links that I do not agree with, but I understand and accept that other users have the right to this information.

2. ShastaNet reserves the right to review any material stored in files to which all users have access, and will edit or remove any material which the ShastaNet Board of Directors, in its sole discretion, believes to be unlawful or otherwise unacceptable. Some administrative personnel of ShastaNet, in the course of their regular duties, have access to communications for technical and operational purposes. ShastaNet may also disclose any communications to the extent permitted or required by law. Privacy will be respected but cannot be guaranteed.

3. All information services and features contained on the ShastaNet are intended for the private use of its patrons except where authorized by ShastaNet for other purposes. I understand that on-line communications between and among users may not be fully confidential. In addition, I'm aware that federal postal regulations do not protect electronic mail.

4. I understand that all information contained on ShastaNet is placed there for general informational, educational and entertainment purposes and is, in no way, intended to refer to, or be applicable to, any person, case, or situation.

5. I shall not post, transmit or make available in any way through ShastaNet any software or other materials which contain a computer virus, trojan horse, timebomb, worm or other rogue programming.

6. ShastaNet does not warrant that the functions of the system will meet any user's specific requirements, or that it will be error-free or uninterrupted; nor shall ShastaNet be liable for any direct, or indirect, incidental, or consequential damages (including lost data, information, or profits) sustained or incurred on connection with the use, operations, or inability to use the system. ShastaNet has no obligation to detect the presence of any Rogue Programming. Any downloading of software or other materials or any other use of the information on ShastaNet is at my risk, and I am advised to take adequate precautions to minimize any loss to my system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.

7. I will abide by the rules and regulations of system usage as may be promulgated by the administration of ShastaNet.

8. ShastaNet is an on-line information exchange service. I shall not post, publish, transmit, reproduce, distribute or in any way use or exploit any information for commercial purposes or otherwise use the information in a manner that is inconsistent with these rules and regulations. Under no circumstances am I permitted to allow any person not authorized to use ShastaNet to gain access to or otherwise use ShastaNet.

9. In consideration for the privilege of using ShastaNet and for having access to the information contained on ShastaNet, I hereby release and waive any and all claims and/or liability against ShastaNet and/or its agents, operators and any institutions with which they are affiliated arising from or in connection with my use of ShastaNet. I also agree to defend, indemnify and hold harmless, ShastaNet and its agents, operators and any institutions with which they are affiliated from and against, any and all claims or liability, including costs and attorneys fees, arising from or in connection with my use of ShastaNet or failure to abide by applicable law.

By registering with ShastaNet, I agree to the Acceptable Use Policy and the terms outlined above.
